General Terms and Conditions for Gift Vouchers, 23.3.2016
These general terms and conditions for gift vouchers issued by ABSTEL Aleš Švagelj s.p., Mavsarjeva cesta 80, 1357 Notranje Gorice (hereinafter: the company) define the rights and obligations related to the company’s gift vouchers.
- General
A gift voucher is a certificate issued by the company against payment, in the form of a document marked with a unique serial number, which the company is obliged to accept as payment for a balloon flight ticket organized by the company, in accordance with these general terms and conditions. - Purchase of a Gift Voucher
The gift voucher can be ordered by email or phone. Contact details are available on the company website: www.baloni.com. Upon purchase, the buyer pays for the gift voucher according to the invoice attached to the voucher. By purchasing the gift voucher, the buyer accepts these general terms and conditions. - Company Obligations
The company’s obligation arising from the gift voucher occurs when the buyer pays the purchase price for the gift voucher. The claim from the gift voucher is tied to the physical document and belongs to the current holder of the voucher. Fulfillment of the claim can be requested by the bearer (holder) of the voucher without any identification. The company’s obligation ceases once the voucher is accepted as payment for a balloon flight ticket organized by the company or if the gift voucher becomes invalid for reasons specified in these terms. The ticket is valid on the date of issue. - Rights of the Voucher Holder
The bearer can request fulfillment of the voucher obligations during the voucher’s validity by email; contact details are on www.baloni.com. The voucher is valid for 6 months from the date of issue, starting from the purchase date. At the express request of the voucher holder, if the bearer books the flight within 6 months from the issue date but weather conditions prevent safe flight on the scheduled day, the validity of the gift voucher is extended by one month from the approval of the extension.
Exchange of the gift voucher for cash is not possible. The voucher can only be redeemed in full. The holder may transfer the voucher to a third party without restrictions by handing over the voucher. The new holder acquires all rights of the previous holder. A full refund of the purchase price is possible within 15 days of purchase. If the voucher is lost or a refund is requested after 15 days, the company will reimburse 50% of the purchase price upon presentation of the valid voucher and invoice. - Passenger
A passenger is a person holding a ticket. Passengers must be taller than the basket edge (110 cm), able to climb in and out of the basket unassisted, and stand for the entire flight. The passenger’s health must allow for the planned flight. Passengers must not be under the influence of alcohol or drugs. Children under six years old or shorter than 110 cm are not transported. Children aged six to twelve must be accompanied by an adult. Children over twelve are treated the same as adults. - Special Category Passengers
A special category passenger is a person requiring special treatment and therefore special transport conditions, assistance, or equipment
a) Persons with reduced mobility due to physical limitations (sensory or motor), mental incapacity, age, or other significant health problems.
b) Persons with chronic or acute illnesses that could affect their well-being during the flight.
c) Persons exceeding the following weight limits:
i. Adult male: 86 kg
ii. Adult female: 71 kg
iii. Male child: 65 kg
iv. Female child: 58 kg
d) Children aged six to twelve accompanied by an adult.
e) Pregnant women - If weather conditions on the scheduled flight day do not allow for safe flight, the company reserves the right to deny boarding to special category passengers and arrange a new flight date. For pregnant women, the validity of the voucher is extended by 6 months upon presentation of a medical certificate.
- Refusal of Passenger
The company may refuse transport if it believes the passenger could endanger the safety of the balloon and others onboard. Refusal can also apply to passengers visibly under the influence of alcohol or drugs or anyone whose presence could obstruct the balloon operator, access to emergency equipment, or safe evacuation. In such cases, the voucher becomes invalid. - Flight Cancellation
The company reserves the right to cancel a flight at any time before takeoff due to technical reasons or unsafe weather conditions and to schedule a new flight. Voucher holders may cancel up to 7 days before the scheduled flight. If canceled on time, a new flight date is arranged. If canceled late, the voucher becomes invalid. - Other Provisions
Nothing may be erased, crossed out, or altered on the voucher; otherwise, it is invalid. The company will refuse to honor counterfeit vouchers. Passengers are insured during the flight under Regulation (EC) No. 785/2004. The company is not responsible for fragile or perishable items, money, jewelry, or other valuable documents. Weapons, explosives, flammable substances, and other dangerous items may only be transported with prior authorization from the authorities and company consent.
